What to do if you are denied Massachusetts Workers' Compensation Benefits?

Massachusetts worker's compensation insurance is designed to protect employees if they are injured on the job. These benefits can include payment for lost wages, unpaid medical bills, or reimbursement of paid medical bills. Although the worker's compensation process is designed to protect the employee, the rules and regulations are so complex that many people do not understand their rights under the law.  It is recommended by the Commonwealth of Massachusetts, Department of Industrial Accidents (DIA) to seek legal representation to protect your rights. Insurance companies know the law. So should you.

Most Massachusetts worker's compensation claims are initially denied by the insurer. There are several reasons that insurance companies use to deny a claim, such as stating that the employee did not provide their employer with proper notification of the accident, that the injury or illness is not work related, or that the worker was an independent contractor and not an actual employee, or the there is no medical documentation to support the claim. In many cases, even if the insurance company is wrong, the employee is forced to fight for his or her rights to receive the benefits that they justifiably deserve. The earlier you contact an attorney, the better.
